2. PCCC Regulatory Update – Removal of PCCC Acceptance Procedure.

Starting June 20, 2026, under Government Resolution 66.18/2026, project developers in Vietnam are allowed to self-certify fire prevention and firefighting (FPF) compliance and put projects into operation without waiting for final inspections from the police authorities. Three administrative procedures have been abolished, including FPF acceptance inspections, FPF acceptance approval for projects with approved fire safety designs, and procedures for restoring operations of suspended facilities or vehicles. As a result, only design appraisal and design approval procedures remain before a project can be put into use.

The reform is expected to shorten project delivery timelines, reduce compliance costs, and give businesses greater flexibility in managing project completion. However, it also places greater responsibility on developers, who must ensure construction, supervision, and acceptance processes fully comply with applicable fire safety standards and technical regulations. 6. When Is a Real Estate Transfer Exempt from Personal Income Tax?

The Vietnamese Government has issued Decree 253, effective from July 1, 2026, providing detailed guidance on the implementation of the Personal Income Tax Law regarding real estate transactions. The decree exempts personal income tax (PIT) on income from the transfer, inheritance, or gifting of real estate including homes and off-plan properties between close family members. Eligible relationships include spouses, parents and children (biological or adoptive), parents-in-law and children-in-law (even after the death of a spouse), grandparents and grandchildren, and siblings. Property divisions resulting from divorce settlements, whether by mutual agreement or court judgment, are also exempt from PIT.

The decree also grants a PIT exemption to individuals transferring their only residential property in Vietnam, provided several conditions are met. The seller must own only one residential property at the time of transfer, have held ownership for at least 183 days, and transfer the entire property rather than a partial interest. The exemption does not apply to off-plan homes or buildings under construction in these cases. Individuals are responsible for declaring their eligibility, and false declarations may result in tax reassessment and legal penalties.
